1. Acceptance of Terms

By accessing or using the Pure Messaging platform at purewhatsapp.co.za, you agree to be bound by these Terms of Service. If you do not agree, do not use the platform.

2. Description of Service

Pure Messaging is a business messaging platform that enables you to send and receive messages, manage contacts, create automated workflows, and send broadcast campaigns through the official WhatsApp Business Cloud API provided by Meta.

3. Account Responsibilities

• You are responsible for maintaining the confidentiality of your account credentials.
• You must ensure all users added to your account comply with these terms.
• You are responsible for all activity that occurs under your account.

4. Acceptable Use

You agree not to use Pure Messaging to:

• Send spam, unsolicited messages, or messages that violate WhatsApp's Business Policy or Commerce Policy.
• Transmit illegal, harmful, threatening, or abusive content.
• Violate any applicable laws, including the Protection of Personal Information Act (POPIA) and the Electronic Communications and Transactions Act (ECTA).
• Attempt to gain unauthorised access to the platform or other users' data.

5. WhatsApp Compliance

You acknowledge that your use of WhatsApp messaging through our platform is subject to Meta's WhatsApp Business Policy and WhatsApp Commerce Policy. You are responsible for ensuring your messages comply with these policies.

6. Billing and Payment

• Fees are charged as outlined on our pricing page and in your service agreement.
• Usage-based charges (template sends, contacts, lines) are billed monthly.
• We reserve the right to update pricing with 30 days' written notice.

7. Data and Privacy

Your use of the platform is also governed by our Privacy Policy. You are responsible for obtaining appropriate consent from your contacts before sending them messages.

8. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted service. The platform depends on third-party services including Meta's WhatsApp Cloud API and hosting infrastructure.

9. Limitation of Liability

To the maximum extent permitted by law, Pure Messaging shall not be liable for any indirect, incidental, or consequential damages arising from your use of the platform, including but not limited to lost revenue, message delivery failures, or data loss.

10. Termination

We may suspend or terminate your access if you violate these terms or engage in activity that harms the platform or other users. You may cancel your account at any time by contacting us.

11. Changes to Terms

We may update these Terms of Service from time to time. Continued use of the platform after changes constitutes acceptance of the revised terms.

12. Governing Law

These terms are governed by the laws of the Republic of South Africa.
